Terms of Service

By downloading, installing, or using WakeWarden ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

WakeWarden grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Modify, reverse engineer, or decompile the App
• Remove any copyright or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the App

WakeWarden is an alarm clock application that:

• Provides local notifications to wake you up at scheduled times
• Stores data locally on your device
• Optionally integrates with third-party services at your discretion

We strive to provide reliable service, but we cannot guarantee that the App will be error-free or available at all times.

You are responsible for:

• Ensuring your device has sufficient battery and is not in Do Not Disturb mode
• Setting alarms correctly and testing notification functionality
• Maintaining the security of your device and data
• Complying with all applicable laws and regulations when using the App

WakeWarden is a tool to help you wake up, but you are ultimately responsible for waking up on time.

The App may integrate with third-party services for API request. Use of these services is optional and subject to their respective terms of service and privacy policies.

We are not responsible for:

• The availability or reliability of third-party services
• Any costs associated with third-party API usage
• The privacy practices of third-party services

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

We do not warrant that the App will meet your requirements or that alarms will function perfectly in all circumstances.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAKEWARDEN AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, or consequential damages
• Lost profits, revenue, or data
• Damages resulting from failure to wake up on time
• Damages resulting from device malfunction or battery depletion

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

You agree to indemnify and hold harmless WakeWarden and its developers from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

We reserve the right to modify these Terms at any time. Changes will be posted within the App, and the "Last Updated" date will be revised. Continued use of the App after changes constitutes acceptance of the modified Terms.

We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the App.

You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or restrict your access to the App at our discretion if you violate these Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which WakeWarden operates, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation. If negotiation fails, disputes may be submitted to binding arbitration in accordance with applicable arbitration rules.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WakeWarden regarding the use of the App and supersede all prior agreements.

By using WakeWarden, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
